Acceptance of Terms of Usage
These Terms of Usage govern your access and use of this Site. By accessing or using this Site you agree to be bound by these Terms of Usage and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this Site. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms of Use.
Graphicprints reserves the right to make changes to this Site and to these Terms of Usage at any time without prior notice. You should review these Terms of Usage each time you access this Site.
You also agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided to us when you registered at our website. You may withdraw your consent to receive communications from us electronically by contacting customer care. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account.
General
All the terms and conditions and/or any transactions occuring online at graphicprints.ca or by phone are subject to the laws of the State of ONTARIO. Graphicprints is not responsible for the delay and/or damages resulting from Machinery Breakdown, Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo. The tools available on graphicprints.ca to create document is the property of Graphicprints and its affiliated companies. The Buyer’s order shall be deemed an acceptance of the Seller's terms. The Terms and conditions shall in all respects be governed by STATE OF ONTARIO law.
Reservations
All orders are subject to acceptance by Graphicprints. We reserve the right to reject any order at any time without recourse. We also reserve the right to change the price at any time even after we receive the order.
Returns
Due to the nature of the product, no returns can be made once the order is processed and/or shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) business days after receipt of the merchandise. We will replace only those orders that were processed incorrectly. The replacement of the order will take place only after the receipt of returned merchandise. We will not replace the order if it is determined by us that the order was misused or mishandle by the buyer or part of the order was used by the buyer and part of the order is being returned.
Credit Card
If the Buyer's credit card is declined, Graphicprints will not process the Buyer’s order. If the order is shipped and should the Buyer's account become delinquent, Buyer agrees to pay a monthly finance charge of 2% (annual percentage rate of 24%) on the unpaid balance. If an account goes beyond the payment term's due date, unless specific arrangements are made, future purchases will require advance payment. In the event that Graphicprints must commence legal action to enforce any terms of this agreement, the Buyer agrees to pay reasonable legal fees and costs.
Warranty
Graphicprints neither makes any explicit warranty nor imply or accepts any responsibility other than possible replacement of the products that Buyer is buying. Graphicprints may but does not guarantee the replacement of the defective product, or credit the amount of the purchase price.
Shipping
Shipping terms are F.O.B. _________. Graphicprints will arrange for shipping with the carrier on behalf of the buyer. The Buyer will be fully responsible for the shipping and handling cost. Graphicprints will not be responsible for the delay in delivery, loss or damage of the order while the order is with the shipping carrier.
Limitation of Liability:
Graphicprints will not be liable in contract or in tort (including negligence) to the customer for incidental or consequential damages, arising out of or resulting from anybody’s performance or nonperformance of our obligations. Graphicprints shall not be liable to anyone for any kind of financial losses, cost, expenses, damages and/or other economic damages. The Buyer agrees that the Buyer will not hold Graphicprints responsible for any and all loss, cost, expense, and damages (including legal costs) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against Graphicprints and its affiliated company (S) on grounds alleging that the said work violates any copyrights, trademarks, service marks, or is scandalous, or invades any person's right to privacy or other personal rights.
Cancellations and Refunds:
Graphicprints and its affiliated company will not refund any money for the orders that were shipped or were cancelled after the order was being processed.
Color Quality:
Graphicprints guarantees that its prints will meet CMYK industry standards. We cannot guarantee "match-print" color fidelity and cannot prevent slight color shift throughout an order. Because we cannot control the color reproduction of a customer's computer monitor, we cannot guarantee that the actual print color will precisely match any preview as it appears your monitor. Graphicprints is not responsible for any color changes in converted images (RGB files) with black, near black, or gray tones. Color shifts from a perceived black or gray must be addressed prior to file submission. Proofs do not guarantee black, near black or gray final output. Please note that the application of UV coating may have an effect upon or change the appearance of printed colors. Graphicprints is not liable for the final color appearance of a UV coated product.
We do not guarantee color matching between a new order and an old order (Even if the old order was printed by us) Variations of color between old and new order are normal in production process.
Graphicprints standard turnaround is dependent on the product ordered; if you do not specify otherwise you will be charged for standard turnaround for the relevant product.
Turnaround times do not include shipping time. The estimated date you will receive your order is a combination of the selected turnaround time and shipping time. Once your order is placed your turnaround time generally cannot be changed and billing charges will not be reversed.
For your convenience, depending on the product ordered, Graphicprints offers a variety of different production turnaround times. Not all of the following turnaround times are offered on every product; the available turnaround times will be listed with product as part of the order process.
Same Day (not available on all products or quantity) -- all production ready jobs received and confirmed by no later than 10:00 a.m. will be ready for shipping or pick by the end of the same day. Production ready jobs not placed and confirmed by 10:00 a.m. will be treated as having been timely received on the following business day.
PLEASE NOTE:
Pick up is available only until 6:00 p.m. (orders completing after 5:00 p.m. may not be available for pick up until the following morning).
Free delivery (if available) will be on the next scheduled delivery day. We do not offer same day turnaround combined with same day free delivery. For example, if your free delivery schedule is on Wednesday and Friday, a same day turnaround order placed on a Monday will not be delivered until Wednesday; if free delivery is available every day, Monday through Friday, the order would be delivered on Tuesday. Please Note: FREE DELIVERY is only available to specific categorized customers, products and locations) Call for more details & eligibility for free delivery.
Same day turnaround is only available for limited quantities .
We reserve the right to print same day turnaround product on our digital presses.
Next Business Day -- all production ready jobs received and confirmed by no later than 10:00 a.m. will be ready by the end of the next business day. Production ready jobs not placed and confirmed by 10:00 a.m. will be treated as having been received before 10:00 a.m. the following business day.
Next Day Plus 1 Day- - all production ready jobs received and confirmed by no later than 1:00 p.m. will be ready the by the end of the second business day after receipt. Production ready jobs not placed and confirmed by 1:00 p.m. will be treated as having been received before 1:00 p.m. the following business day.
2-4 Day -- all production-ready jobs received and confirmed by no later than 1:00 p.m. will be ready between 1:00 p.m. the second business day after receipt and 1:00 p.m. on the fourth business day after receipt.
3-5 Day -- all production-ready jobs received and confirmed by no later than 1:00 p.m. will be ready between 1:00 p.m. the second business day after receipt and 1:00 p.m. on the fourth business day after receipt.
5-7 Day -- all production ready jobs received and confirmed by no later than 1:00 p.m. will be ready between 1:00 p.m. the fifth day after receipt and 1:00 p.m. on the seventh day after receipt.
Please note: – Turnaround times for jobs that Graphic Prints does not deem production ready (e.g., those with problems or that require a proof) will not begin until the job is approved and ready for production.
If you choose group shipping this may add at least one additional day to your chosen turnaround time.
